Terms of Service

These terms govern your use of East & Marcks' business operating systems, Orbit OS, Grandir OS, Intel OS, and Opus OS (together, the "Services"). By creating an account or using the Services, you agree to them.

1. The Services

The Services are software platforms that help businesses run email campaigns, advertising, data intelligence, and operations with AI assistance. The Services are provided as a private beta unless you have signed a separate order form or agreement with us.

Email sending and consent

Email is sent only from mailboxes and domains you connect to the Services. Nothing is sent without your approval, and you are responsible for having permission to contact the people you choose and for complying with applicable marketing and anti-spam laws. Accounts whose sending generates complaint or abuse reports may be paused to protect delivery for other users.

2. Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity that happens under your account. Tell us immediately at support@eastandmarcks.com if you believe your account has been compromised.

3. Acceptable use

You agree not to:

• use the Services to send spam, unlawful, harassing, or deceptive communications, or to violate any applicable marketing-consent laws;
• connect advertising or data accounts you do not have the right to use;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the Services or other users' data;
• resell or provide access to the Services to third parties without our written permission.

4. AI-generated content

Campaign drafts, messages, and analyses produced by the Services are generated with AI models and may contain errors. You review and approve anything before it is published or sent, and you are responsible for the final content you choose to publish through your own accounts.

5. Connected platforms

The Services integrate with third-party platforms such as advertising networks. Your use of those platforms remains subject to their own terms and policies, and we are not responsible for actions those platforms take against your accounts, including ad disapprovals or account restrictions.

6. Fees and beta access

Some parts of the Services are free during the beta; others are billed as agreed with you in writing. Unless stated otherwise, fees are non-refundable where the Service has been delivered. We may change pricing with reasonable advance notice.

7. Availability

We aim for high availability but the Services are provided "as is" during the beta, without warranties of uninterrupted operation. We may modify, suspend, or discontinue parts of the Services, with notice where practical.

8. Your data

You keep ownership of the business data and content you submit. You grant us the limited rights needed to operate the Services, storing, processing, and displaying it for you. How we protect personal data is described in our Privacy Policy.

9. Limitation of liability

To the maximum extent permitted by law, East & Marcks is not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the Services is limited to the amount you paid us in the twelve months before the claim.

10. Termination

You may stop using the Services and request account deletion at any time. We may suspend or terminate accounts that breach these terms. Sections that by their nature should survive termination (including ownership, liability, and payment obligations) will survive.

11. Changes

We may update these terms as the Services evolve. Material changes will be announced by email or in the Services before taking effect. Continuing to use the Services after that means you accept the updated terms.
